The contract of sale is between the entity named on the invoice (the “Customer”) and Access Hair Pty Ltd (“accesshair.com.au”).

All goods are supplied on these terms and conditions only and no person in the employment or otherwise acting as an agent for accesshair.com.au has any authority to supply goods on any other terms and conditions or to vary these terms and conditions in any way whatsoever. Previous dealings shall not vary or negate these terms and conditions in any respect.

Introduction

These terms and conditions are set to protect both our customers and accesshair.com.au, please read them carefully. The use of this site is governed by the policies, terms and conditions set forth below. Please read this thoroughly.

We are Access Hair Pty Ltd/accesshair.com.au, ABN 65 647 046 768, PO Box 211 Marrickville NSW 2204.

Your use of this site, placement of orders and activity via our public forums and reviews are governed by these terms and conditions. By agreeing to place an order and partaking in our public forums you agree to be legally bound by these Terms and Conditions. These Terms and Conditions shall apply to all orders and Contracts made or to be made by us for the sale and supply of goods. When you order with us, give any delivery instruction or accept delivery of the goods, this shall in any event constitute your unqualified acceptance of these Terms and Conditions. Nothing in these Terms and Conditions affects your statutory rights.

These Terms and Conditions shall prevail over any separate terms put forward by you. Any conditions that you submit, propose or stipulate in whatever form and at whatever time, whether in writing, by email or orally, are expressly waived and excluded.

All goods are supplied on these terms and conditions only and no person in the employment or otherwise as agent for accesshair.com.au has any authority to supply goods on any other terms and conditions or to vary these terms and conditions in any way whatsoever. Previous dealings shall not vary or negate these terms and conditions in any respect.

You the customer

accesshair.com.au requires its customers and patrons to be at least 18 years of age and possess a valid and authentic Credit or Debit card by an acceptable bank.

By offering to purchase goods and services you represent to us that you are 18 years of age or over and authorise us to transmit information (included updated information) to obtain information from third parties, including but not limited to, your debit or credit card numbers or credit reports to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

The agreement

All prices and charges are in Australian Dollars. All prices listed are inclusive of any Australian Goods and Services Tax applicable. All sales shall be deemed to be made in the state of NSW, Australia, regardless of the location of the Customer. The Customer agrees that any dispute with accesshair.com.au shall be brought by the Customer exclusively in the state or federal courts situated in the State of NSW.

When placing an order, for the order to be processed and accepted by us, accesshair.com.au, you must register for an account on accesshair.com.au. To ensure that you are making your order correctly, instructions on how to create orders or alter orders must be followed prior to submitting your order. When you sign up for an account at accesshair.com.au, you will provide us with certain personal information. Your personal information may be used for providing you with news, offers and information about Access Hair and promotions run by the Access Hair Group, as well as for the purposes set out in the agreement. You may choose to unsubscribe from our newsletter by following the unsubscribe link in any email received or by emailing us at shop@accesshair.com.au and requesting to be removed from future mailing lists.

Regardless of any advertising or pricing that you may have seen, once you have selected the required product you wish to order, the charges that are required will be displayed to you with any extra charges that may apply, including delivery. This is the total that is required to be paid. Although Access Hair Pty Ltd endeavours to make sure all prices and charges displayed to you are accurate and correct at the time of the order placement, as a part of our order acceptance process all prices are required to be validated by us prior to acceptance.

This includes, but is not limited to, product prices as well as shipping and transit costs. 
We shall not be obliged to supply the goods to you until we have accepted your order. Unless expressly stated that we accept your order, email, letter, fax or other acknowledgement of your order by us is purely for information purposes only and does not constitute the confirmation of the order. In that acknowledgement, we may give you a reference number and details of the product you have requested to order.

We may at our discretion refuse to accept an order due to unavailability of supplies, where we believe there may be credit card fraud, or if there has been an error in the price or product description. In the event that we are unable to fulfil your order, we will provide a full refund of any payment received. All orders placed must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order. accesshair.com.au reserves the right at any time after receipt of your order to accept or decline your order for any reason.

For cybersecurity reasons, transactions that fulfil certain criteria may be subject to security checks. As part of our security check system, you authorise accesshair.com.au to transact nominal additional charges via the payment method of your choice. This charge will be refunded immediately. Upon verification that you have access to, and are the sole payment account holder, your order will be released. 

You must pay for the goods in full at the time of ordering by supplying us with your credit or debit card details from a credit or debit card company accepted by us or by any other third party payment processing platform, which we require in order to process your order. Alternatively, you may pay by any method that we have said is acceptable to us, like direct debit, in any event we shall not be bound to supply before we have received cleared funds in full.

Our confirmation of order shall be deemed to come into effect when we have dispatched it. Until the time when we accept your order, we reserve the right to refuse to process your order and you reserve the right to cancel your order. If accesshair.com.au or you cancel your order prior to acceptance, then we will promptly refund any payment already made by you or your credit or debit card company to us for the order of the goods.

You warrant that the personal information which you are required to provide when you register and order is true, accurate, current and complete in all respects; and you are not impersonating any other person or entity. You also warrant that you are the Credit Card or account holder for the method of payment used. The products purchased on this site are for private and domestic use only and are not for resale. We reserve the right to obtain validation of your payment details before providing you with the product.

You must only submit to us information which is accurate and not misleading and you must keep it up to date and inform us of any changes.

Delivery

All delivery times given by accesshair.com.au are estimates only and we cannot promise an exact date. We always aim to deliver within 1-5 working days from the date of any order which we accept but we cannot guarantee any firm delivery dates.

We will aim to let you know if we expect that we are unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery. In the event that multiple items are ordered, part deliveries may be made where stock is not available.

On delivery of the Product, you may be required to sign for delivery. The goods must be inspected prior to signature for any obvious faults, defects or damage. You should take care in unpacking parcels and using sharp utensils, so as to not damage the contents. Should you find that the items received are faulty/incorrect you must contact us within 3 working days of receipt of the goods.

You must ensure that you will be available for acceptance of the goods at the delivery address provided by you within a reasonable time. Delivery or collection is delayed through your unreasonable refusal to accept delivery or if you do not (within 7–14 days of our first attempt to deliver the goods to you) accept delivery or collect the goods from the carrier, then we may (without affecting any other right or remedy available to us) no longer make the goods available for delivery or collection and notify you that we are immediately canceling the applicable agreement, in which case we will refund to you or your credit or debit card company as applicable any money already paid to us under the applicable agreement, less 15% in administration charges plus the delivery fee (including for attempting to deliver and then returning the product).

The shipping address for your order is shown in the checkout, my accounts and on your order confirmation and shipping confirmation emails. In the event that an incorrect address was entered, address changes can only be made until the order begins processing. accesshair.com.au will try but cannot guarantee to accommodate address change requests.

accesshair.com.au takes no responsibility for orders shipped to an incorrect or invalid address and is not liable for any losses incurred.

accesshair.com.au shall under no circumstances be liable for special, incidental, or consequential damages including loss of profit or opportunity, even if it has been advised of the possibility of such damages; the maximum liability for all direct damages, if any, arising out of any action shall be limited to an amount not exceeding the purchase price of the product.

***Important notice regarding Transit Cover: Goods Damaged or Lost in Transit: ***

Customers have an option to purchase transit cover which will cover the replacement of parcels that have been lost or damaged in transit. In the event that a customer purchases transit cover and their parcel is lost or damaged in transit, accesshair.com.au will resend the goods ordered at no additional cost once we receive written confirmation by the postal or courier company that the parcel was undelivered. In the event a product in that order is limited in quantity, items that are no longer available will be refunded back to the customer

In the event that a parcel is lost or damaged in transit, and the customer has not purchased transit cover, accesshair.com.au will not be liable for replacing or refunding the goods or the value of the goods. The customer assumes all risks regarding the possibility of problems that may arise in transit if they chose not to purchase transit cover.

Subject to any applicable Commonwealth or State legislation, accesshair.com.au’s liability for any such breach shall be limited, at its sole discretion, to any of the following:

  • Replacement of the goods or any part thereof;
  • Supply of equivalent goods or any part thereof;
  • Repair of the goods or any part thereof;
  • Payment of the cost of replacing the goods or acquiring equivalent goods or any part thereof;
  • The payment of the cost of having the goods or any part thereof repaired; or
  • Refund of the goods upon return.

Cancellations & Refunds

We may cancel an order if the goods are not available for any reason. We will notify you if this is the case and return any payment that you have made. We will usually refund any money received from you using the same method originally used by you to pay for the goods.

You are responsible for all orders placed on your account, including for any discrepancies or errors in your order caused by you. Goods in your cart are not reserved until you have completed the checkout process. You must review your order carefully before placing it. Once an order is confirmed, you are unable to cancel or change it. If you have any problems with your order, then you must go through the normal returns process outlined in our Terms and Conditions. Please note that change of mind returns are given at our absolute discretion. As a general rule, we will not change or replace your order where you have made an error.

If you wish to cancel your order please contact our Customer Service Team at shop@accesshair.com.au. Once an order has been dispatched it may not be cancelled and the item must instead be processed as a return and must be returned to the company.

We aim to process refunds and replacements within 28 days of receipt by us of the original product, however, depending on your item and the number of returns in our system, this may take longer.

Warranties and Repairs

All warranties offered are the manufacturers warranties and not that of accesshair.com.au. Each manufacturer provides its own warranty periods and these will vary for each product.

All repairs are carried out by the manufacturer and not by Access Hair. In some cases, faulty items cannot be repaired and a replacement or refund will be offered. Access Hair cannot control the availability of parts of replacement goods.

accesshair.com.au has no control over manufacturer repair periods and cannot advise what they will be. We will however do everything we can to ensure your faulty item is handled as quickly as possible and that you are informed throughout the process. In cases where you have returned goods directly to the manufacturer, accesshair.com.au cannot be held accountable for repair periods or communication from the manufacturer.

Faulty Products

We warrant that the goods will conform with the manufacturer’s latest published instructions as set out on the site or in our goods material at the time of your order.

The goods are intended to be used strictly in accordance with the manufacturer’s latest published instructions as set out on our site or directly on the goods or packaging itself. It is your responsibility to ensure that you use the goods strictly in accordance with those instructions.

We will make every attempt to deliver goods in a satisfactory condition. However, if you tell us that the goods are faulty, you agree to keep the goods in its current condition available for us (or our agent) to inspect within a reasonable time.

In order to provide you with any remedies for a faulty goods, we may need your assistance and prompt provision of certain information regarding the goods, including:

  • you specifying with reasonable detail the way in which it is alleged that the goods are damaged or defective; and
  • you provide us with other information as we reasonably require to help in resolving your issue.

After delivery by us, we may at our discretion decide not to repair, replace or refund you for the product and/or we may require you to pay all reasonable carriage costs and servicing costs at our current standard fees and costs and charge this to your credit or debit card, or the payment details that you provided to us when you made your order and, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result of a product being:

  • misused, abused or subjected to neglect, improper or inadequate care, carelessness, damage or abnormal conditions; or
  • involved in any accident or damage caused by an incorrect attempt at modification or repair; or
  • dealt with or used contrary to our or the manufacturer’s instructions for the product; or
  • deteriorated through normal wear and tear.

Amendments

We reserve the right to amend these terms and conditions at any time. All amendments to these terms and conditions will be posted online. However, continued use of the website will be deemed to constitute acceptance of any new terms and conditions.
